1. AKC Registration
Buyer agrees to register this puppy with the AKC within two (2) months from the date of this sale.
2. Wellness Check Agreement
This puppy must be taken to a licensed veterinarian within forty-eight (48) hours from the date of sale for a wellness check. A veterinary signed report detailing the wellness check must be sent to vom Heinolf as proof. Any claims must be made within this forty-eight (48) hour time period and will be verified by vom Heinolf's own veterinarian or a veterinarian of our choosing. If this puppy is proven to not be in good health buyer may return the puppy and receive a refund (less the deposit). If the puppy is returned, all his/her paperwork and veterinary records to date must accompany the puppy. Failure to see a veterinarian within forty-eight (48) hours and send a veterinary signed report to us will void this agreement. ______________ (buyer initial)
3. Non-Breeding Agreement
______This puppy is sold with the NON-BREEDING agreement and with limited registration, requiring spay/neuter by twelve (12) months of age. If said dog is over twelve (12) months of age, buyer has exactly thirty (30) days to spay/neuter the dog. A copy of the receipt from your veterinarian showing proof of spay/neuter must be given to vom Heinolf as proof. ______________ (buyer initial)
4. Breeding Agreement
______This puppy is sold with the BREEDING agreement and with limited registration. At two (2) years of age this dogs hips and elbows must be x-rayed by a licensed veterinarian skilled at producing x-rays for OFA certification. A copy of these x-rays must be sent to vom Heinolf. These x-rays must then be submitted to the OFA for certification and proof of passing ratings given to vom Heinolf. Passing ratings are "EXCELLENT", "GOOD" and "FAIR" for hips and "NORMAL" for elbows. When these conditions are met vom Heinolf will reverse the registration to full. The AKC application processing fee is the responsibility of the buyer. Buyer agrees that they will only breed their dog to an AKC registered German Shepherd that is within the breed standard and is of equal quality that has been certified by the OFA/SV/PENNHIP to be clear of hip and elbow dysplasia. ______________ (buyer initial)
5. Shipping Agreement
Shipping is always in addition to the cost of the puppy and is the responsibility of the buyer. We ship puppies with Delta airlines from the airport in Springfield, MO. When shipping a puppy vom Heinolf and the buyer agree to the following terms: buyer assumes all risks and expenses of shipping which includes a crate, airfare, health certificate and money for our time/fuel. We are in no way responsible for loss, death, or injury during transport to the new home. Buyer will need to settle any disputes, should they arise, with the airlines NOT vom Heinolf. We are NOT responsible for associated changes which can occur due to shipping. These include stress, low blood sugar and loose stools. ______________ (buyer initial)
6. Other Agreements
Buyer agrees to send pictures and updates at six (6) months, twelve (12) months, eighteen (18) months and twenty-four (24) months. Buyer also agrees to maintain this dog in good health, provide routine preventative health care including, but not limited to, inoculation, internal and external parasites and heartworm preventative medication. Buyer also agrees that this dog is not to be left solely in a backyard or a kennel. This dog is sold with the understanding that he/she will become a member of the family and treated as such. Buyer agrees to allow vom Heinolf to use the dogs name, picture and/or other information in advertising providing that we give the seller recognition of ownership where appropriate. ______________ (buyer initial)
7. Right of Refusal
If for any reason buyer is unable to keep the puppy/dog, vom Heinolf MUST be notified in writing and given first right of refusal. We agree to answer any offer of purchase within two weeks with a written response indicating our decision to repurchase or not repurchase the dog. If we decline to purchase said dog or a purchase price cannot be decided upon then buyer may sell said dog on the condition that the new home be approved by vom Heinolf and we are supplied with their name, address, email and phone number. If we decide to exercise first right of refusal, the buyer agrees (at their expense) to get a full wellness check of said dog and provide us with a veterinary signed report. Buyer also agrees to provide us with x-rays of said dogs hips & elbows (using proper OFA positioning) for grading. Buyer also agrees to supply us with signed AKC registration certificate and all veterinary records to date. This dog is UNDER NO CIRCUMSTANCE to be surrendered to a shelter, humane society or a rescue group. ______________ (buyer initial)
8. Violations
Violations of the terms of this contract renders all guarantees null and void. Buyer agrees vom Heinolf has the right to reclaim said dog upon evidence of neglect or abuse. There will be no compensation to the buyer should this happen. In this event the AKC registration must be signed over to vom Heinolf and accompany the dog along with all current veterinary records to date. Should vom Heinolf seek legal action against the buyer for violations of this agreement, the buyer will assume any and all expenses including but not limited to, court costs, reasonable attorney fee, veterinary costs that may be needed for the dog and our time at $25 an hour. In the event of any dispute, it is agreed that the place of venue shall be the county of Carroll in the state of Arkansas. ______________ (buyer initial)
